("Lot Lever," "we," "us," or "our"). By creating an account or using our Services, you agree to these Terms on behalf of yourself and your organization.

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. The Lot Lever pixel may only be deployed on websites you own or operate. By deploying the pixel, you represent that:
The Services include AI-powered features that generate content including emails, responses, marketing copy, and insights. You are responsible for reviewing AI-generated content before use. Lot Lever makes no warranty that AI-generated content is accurate, complete, or suitable for any particular purpose. You must not represent AI-generated content as human-written in contexts where that distinction is material.
By using the Services, you grant Lot Lever a limited license to process data you provide or that is collected through your use of the Services, solely to provide the Services. Our Privacy Policy is incorporated into these Terms by reference. You represent that you have obtained all necessary rights and consents to provide us with any personal data you upload or that is collected through your deployment of our technology.
The Services may transmit data to third-party CRM systems and marketing platforms at your direction. You are responsible for your use of such integrations and for ensuring compliance with the terms of those third-party services. Lot Lever is not responsible for the actions or policies of third-party services.
Lot Lever retains all rights to the platform, algorithms, AI models, and underlying technology. You retain ownership of content you create using the Services. You grant Lot Lever a limited license to use aggregated, anonymized data derived from platform usage to improve the Services.
Subscription fees are billed in advance on a monthly or annual basis as specified at signup. Fees are non-refundable except as required by law. We may change our pricing with 30 days' notice. Failure to pay may result in suspension or termination of your account.
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR ACHIEVE ANY PARTICULAR RESULT. AI-GENERATED INSIGHTS ARE NOT GUARANTEED TO BE ACCURATE AND SHOULD NOT BE RELIED UPON AS THE SOLE BASIS FOR BUSINESS DECISIONS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOT LEVER'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE FEES YOU PAID IN THE THREE MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL LOT LEVER BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
These Terms are effective until terminated. Either party may terminate with 30 days' written notice. We may suspend or terminate your access immediately for material breach of these Terms, non-payment, or conduct that poses a risk to the platform or other users. Upon termination, your data will be retained for 90 days during which you may export it, after which it will be deleted.
These Terms are governed by the laws of the State of Ohio, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Cuyahoga County, Ohio, and both parties consent to the personal jurisdiction of such courts.
We may update these Terms at any time. We will provide notice of material changes via email or platform notification at least 14 days before they take effect. Continued use of the Services after the effective date constitutes acceptance.
